Recent Pitbull Attacks Responsible for Death of Two Young Children

PitbullWhen it comes to dog attacks, the debate over whether it is the breed of dog or the owner of the dog that is the problem is always contentious. And yet one thing remains certain, the continual reports of injury and even death by dog bite in the media show the need for awareness and protection when it comes to dangerous dogs.

Studies show that more than 60 percent of dog bites are from Pit Bull or Pit Bull mixed breeds, followed by Rottweilers at just over 8 percent. Other breeds, however, can also be involved in vicious attacks. While Pit Bulls are indeed the most common, during the past 36 years of prosecuting owners of vicious dogs involved in attacks, I have also dealt with breeds including Rottweilers, Chow Chows and Akitas.

Sadly, the vast majority of dog bite victims are vulnerable senior citizens, young children and babies. Recently in Gilbert, Arizona, a 2-year-old boy died following an attack by Pit Bulls while his babysitter required surgery from injuries gained in that attack. Just two days later, a 2-year-old boy in was killed in another Pit Bull attack in Colton, California. He had climbed out the window of the family home and was mauled to death in the backyard. Unfortunately, these are just two of the vast number of deaths and injuries that occur every year from vicious dog attacks.

Insurance companies have concluded that no matter the cause, Pit Bulls and Pit Bull mixes are too dangerous to insure, and they are excluding them from homeowner’s policies. The result is victims of dog bites suffer twice; first the injury, then no recourse for recovering medical expenses, etc.

In California, the law is clear. If a dog bites someone, the owner is always responsible. It doesn’t matter if the owner had knowledge of the potential for the dog to attack or not.
